1. Overview

This website is operated by Lobaba ("Lobaba", "we", "us", "our"). Throughout the site, these terms refer to you as "you" or "your". By visiting lobabahairclips.com, browsing it, or buying something from it, you agree to everything set out below, together with our Privacy Policy, Shipping Policy, Return & Refund Policy and any other policy linked from this site. If you do not agree, please do not use the site.

We may add new features, products or tools to the store at any time. Anything we add is covered by these terms too.

2. Who can order

To buy from Lobaba you must be at least the age of majority where you live, or have the consent of a parent or guardian who accepts these terms on your behalf. You may not use our products or this site for any illegal purpose, or in any way that breaks the law where you live.

3. Your account

If you create an account, you are responsible for keeping your password private and for everything that happens under your account. Tell us straight away if you think someone else is using it. We may refuse service, close accounts or cancel orders at our discretion.

4. Our products

We do our best to show our clips and gem sheets accurately, but we cannot promise that your screen shows colours exactly as they are in real life. Small differences in shade, finish and placement are normal.

Photographs of decorated clips are samples. Gem sheets are applied by hand, so the finished look of your own clip will differ from ours. The gems are supplied loose on a sheet; how you arrange them is up to you.

Safety. Gem sheets contain small parts. They are not suitable for children under 3 years old and should be kept away from eyes and mouths. Hair clips are hair accessories, not toys. Please supervise young children using them.

Products are offered while stocks last. We may change or discontinue a product, colour or style at any time, and we may limit the quantity of any item we sell.

5. Orders

An order you place is an offer to buy. It is accepted only when we send you a confirmation that your order has shipped. Until then we may decline or cancel it — for example if an item is out of stock, if the price or description was wrong, or if we suspect fraud. If we cancel an order you have already paid for, we will refund you in full.

You agree to give complete and accurate billing, shipping and contact details, and to keep them up to date so we can reach you about your order.

6. Prices and payment

Prices are shown in the currency displayed at checkout and may change at any time before you order. Taxes and shipping are calculated at checkout. Depending on where you live, import duties or customs charges may be payable on delivery; those are your responsibility and are not included in what you pay us.

Payments are handled by Shopify and its payment providers. We do not store your full card details.

7. Shipping and delivery

Delivery times shown on the site are estimates, not guarantees. Once a parcel is handed to the carrier, delays caused by the carrier, by customs, or by weather are outside our control. Risk passes to you when the parcel is delivered to the address you gave us. Our Shipping Policy has the details.

8. Returns and cancellations

Our Return & Refund Policy forms part of these terms. If you are a consumer in the European Union or the United Kingdom, you also have a statutory right to withdraw from your purchase within 14 days of receiving it; see our Withdrawal page for how that works. Nothing in these terms takes away rights you have under the consumer law where you live.

9. Promotions and discount codes

Discount codes, gift-with-purchase offers and free-shipping thresholds are valid only for the period and on the items we state. Unless we say otherwise: one code per order, codes have no cash value, and they cannot be applied to an order that has already been placed. We may withdraw or change an offer at any time, and we may cancel orders where a code has been used in a way it was not meant to be.

10. Email and marketing messages

If you join the Lobaba club or opt in at checkout, you agree to receive marketing emails from us. You can unsubscribe from any of them using the link at the bottom of the email. We will still send you transactional messages about orders you have placed. If we ever offer text messages, they will be opt-in, and message and data rates may apply.

11. Intellectual property

The Lobaba name, logo, product designs, photographs, illustrations, text and page designs on this site belong to us or are used with permission. You may not copy, resell, or use them commercially without our written consent. Buying a product does not transfer any of these rights to you.

12. Your content and feedback

If you send us photos, reviews, ideas or suggestions — by email, by tagging us, or through this site — you give us permission to use, reproduce and publish them in connection with Lobaba, without payment and without obligation to keep them confidential. You confirm that the content is yours to share and that it does not infringe anyone else's rights. We may remove or decline to publish anything at our discretion.

13. Third-party tools and links

We may give you access to third-party tools that we neither control nor monitor. They are provided "as is" and your use of them is at your own risk. This site may also link to third-party sites; we are not responsible for their content, products or policies. Please read their terms before you use them.

14. Shopify

This store is hosted on Shopify, which provides the online platform that lets us sell to you. Shopify is not a party to your purchase and is not responsible for the products we sell or for any dispute between you and us.

15. Privacy

Information you give us is handled as set out in our Privacy Policy, which forms part of these terms.

16. Errors and inaccuracies

Occasionally the site may contain a typo, an out-of-date price, or an incorrect description or image. We may correct any of these and may cancel or change an order placed on incorrect information, even after you have submitted it. We are not obliged to update information on the site except where the law requires it.

17. Things you must not do

You may not use this site or our products to break the law; to infringe anyone's intellectual property; to harass, abuse or discriminate against anyone; to submit false information; to upload viruses or malicious code; to collect or track other people's personal information; to spam, phish or scrape; or to interfere with the security of the site. We may end your access for doing any of these.

18. Automated access

Bots, scrapers and other automated software may access the site only in line with our robots.txt and only in a way that does not degrade it for anyone else. Any automated agent acting for you is your responsibility, and you are bound by what it does on your behalf.

19. Termination

These terms apply for as long as you use the site. You or we may end the relationship at any time. Obligations that by their nature should survive — payment for orders already placed, intellectual property, disclaimers, limitation of liability and indemnity — survive termination.

20. Disclaimer of warranties

Except where the law says otherwise, the site and our products are provided "as is" and "as available", without warranties of any kind, whether express or implied, including implied warranties of merchantability or fitness for a particular purpose. We do not warrant that the site will be uninterrupted or error-free, or that any result you get from using it will be accurate or reliable. Some jurisdictions do not allow these exclusions, so parts of this section may not apply to you.

21. Limitation of liability

To the extent permitted by law, Lobaba and its owners, employees and suppliers are not liable for any indirect, incidental, special or consequential loss arising from your use of the site or our products, and our total liability to you for any claim is limited to the amount you paid for the product the claim relates to. Nothing here limits liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be limited.

22. Indemnity

You agree to indemnify and hold harmless Lobaba and the people who work with us from any claim or demand, including reasonable legal fees, brought by a third party because you breached these terms or the law.

23. Governing law and disputes

These terms are governed by the laws of the State of North Carolina, United States, without regard to its conflict-of-law rules. Any dispute will be brought in the state or federal courts located in North Carolina, and you agree to their jurisdiction. If you are a consumer resident in the EU or the UK, this does not deprive you of the protection of the mandatory consumer law of the country where you live, or of your right to bring proceedings there.

Before starting formal proceedings, please contact us — most problems are quicker to fix by email.

24. General

If any part of these terms is found unenforceable, the rest still applies. If we do not enforce a right, that is not a waiver of it. These terms, together with the policies linked from this site, are the whole agreement between us and replace any earlier understanding. You may not transfer these terms to anyone else; we may transfer them if our business is sold or reorganised. Headings are for convenience only and do not affect meaning.

25. Changes to these terms

We may update these terms from time to time. The current version is always on this page, with the date it was last changed at the top. Continuing to use the site after a change means you accept the new version. Changes do not affect orders already placed.
